San Carlos (KFXV) — A fatal accident that claimed the life of one person and left another person injured in San Carlos just last week is now being taken to court.
The attorney of the 23 year old survivor tells Fox 2 News, his client suffered major internal injuries that could have been prevented a long time ago.
Almost a week after an ATV accident claimed the life of Rigoberto Rendon, Esau Zuniga-Gallegos who was a passenger in the ATV has filed a lawsuit against the Hidalgo County Drainage District No.1, and RDH Site and Concrete, LLC.
His attorney, Armando Guerra tells Fox 2 News, the injuries his client suffered could have been prevented. A restraining order against all three defendants has been issued by a judge for the next 14 days considering the work done in the drainage canal prevents investigators from reconstructing the scene of the accident.
Department of Public Safety Spokesperson, Johnny Hernandez says a toxicology report will be available for Rendon in the next few weeks.
We are still waiting to hear back from the county’s drainage system on the lawsuit.
A court hearing for this case is scheduled for September 1st.
